Scope of work
The scope of work is defined by the approved design, the final Bill of Quantities and the signed agreement. Any item not listed in those documents is treated as a variation and will be quoted separately before it is carried out.
These terms apply to design and execution services provided by NITS Decor LLC. They are summarised here for reference; the terms in your signed agreement take precedence.
The scope of work is defined by the approved design, the final Bill of Quantities and the signed agreement. Any item not listed in those documents is treated as a variation and will be quoted separately before it is carried out.
Where design services are engaged without execution, design fees are calculated on the area of the space at a rate of AED 50 per square foot, unless agreed otherwise in writing.
Payments for design and execution projects fall due against the following milestones:
| Milestone | Portion |
|---|---|
| Booking / project confirmation | 10% |
| On completion of 3D design | 25% |
| Prior to commencement of execution | 25% |
| At 50% completion of execution | 30% |
| At 80% completion of execution | 10% |
Works may be paused where a milestone payment is outstanding, and any resulting delay to the programme is not treated as a delay attributable to the studio.
The Design Docket — comprising renders, 2D drawings, the final Bill of Quantities, the scope of work and the material log — is released once 60% of the value of the final Bill of Quantities has been paid.
Changes requested after design approval may affect both cost and programme. Variations are documented, priced and approved in writing before the affected works proceed.
Natural materials vary in colour, veining and grain between batches; samples indicate character rather than an exact match. Where a specified item becomes unavailable, or its lead time would materially delay the programme, an equivalent alternative will be proposed for your approval.
The client is responsible for providing clear access to the site, together with any landlord, developer or community approvals and permits required for the works to proceed. Delays arising from access, approvals or pre-existing site conditions are outside the studio’s control.
Programme dates are based on the approved scope and on uninterrupted site access. Delays caused by variations, late approvals, outstanding payments, authority processing or events outside reasonable control will extend the programme accordingly.
On completion a joint walkthrough is carried out and a snagging list agreed. Workmanship is warranted for the period stated in your agreement, and manufacturer warranties apply to supplied products and equipment. Fair wear and tear, misuse, and works carried out by others are excluded.
All drawings, renders, concepts and design documentation remain the intellectual property of NITS Decor LLC, and may not be reproduced or issued to a third party for execution without written consent.
We may photograph completed work for our portfolio. Where a project is confidential, or you would simply prefer it not to be published, tell us and it will not be.
Where a project is cancelled, amounts covering work already performed, materials already ordered and commitments made to suppliers on your behalf remain payable. The booking amount is non-refundable.
These terms are governed by the laws of the United Arab Emirates. Any dispute falls under the exclusive jurisdiction of the courts of Dubai.
